Please read this document carefully before signing. By signing below, you are agreeing to release the Organizer from certain legal rights. This is a binding legal agreement.
This waiver applies to your participation in a privately organized group trip hosted by Amazing Soulcations or one of its hosts (the "Organizer"). Trip-specific details, including dates and destination, are provided in your trip's materials.
I, the undersigned participant, acknowledge that international travel involves inherent risks that cannot be fully anticipated or controlled. I voluntarily accept and assume all risks associated with participation in this trip, including but not limited to:
Additional risks specific to this trip's activities and destination, if any, are listed in your Trip Supplement and are incorporated into this assumption of risk by reference.
In consideration of being permitted to participate in this trip, I hereby release, waive, discharge, and agree to hold harmless the Organizer and all associated staff, contractors, and agents (collectively the "Releasees") from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, injury, or death that may be sustained by me during or in connection with my participation in this trip.
This release includes claims arising from the negligence of the Releasees, except in cases of gross negligence or willful misconduct.
I agree to indemnify and hold harmless the Releasees from any loss, liability, damage, or cost they may incur arising from my participation in this trip, including any damage or injury I may cause to myself, other guests, third parties, or property.
The Organizer is not responsible for the acts, omissions, or negligence of any hotel, tour operator, activity provider, or any other third-party service provider engaged in connection with this trip. Any claims arising from third-party services must be directed to the relevant provider.
I confirm that it is my sole responsibility to consult with my physician prior to the trip regarding any health concerns. I confirm that I have adequate health insurance, and travel insurance, to cover the costs of medical treatment and evacuation in the event of any injury or illness while traveling.
I agree to comply with the Amazing Soulcations Code of Conduct. I understand that any behavior deemed disruptive, disrespectful, illegal, or harmful to myself or other guests may result in my immediate removal from the trip without refund.
I grant the Organizer permission to photograph or video me during this trip and to use those images for future marketing, including on websites, social media, and printed materials. I may opt out of this by notifying the trip administrator in writing prior to departure.
The Organizer is not liable for any failure to perform their obligations under this agreement where such failure results from circumstances beyond their reasonable control, including but not limited to natural disasters, pandemic, government action, civil unrest, or other events of force majeure.
This agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising from this agreement or from participation in this trip shall be subject to the exclusive jurisdiction of the courts of Fort Lauderdale, Florida. I agree to pay any attorney fees or costs incurred by the Organizer in enforcing this agreement.
If any portion of this agreement is found to be invalid or unenforceable by a court of law, the remaining provisions shall continue in full force and effect.
I have carefully read this waiver and release of liability, along with any Trip Supplement that applies to my trip. I fully understand its contents and I am aware that this is a release of liability and a binding legal contract. I understand that my acknowledgment and electronic signature are recorded through the central Amazing Soulcations registration form.
